29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) 5 Tennis Court Lane, Rumson NJ - The employer did not ensure that a program consisting of energy control procedures, employee training, and periodic inspections were established before any employee performs maintenance or service work on a John Deere Turf Collection System TC125 so that the hopper, or any other affected part, is isolated from the energy source and rendered inoperative. This violation occurred on or about 09/14/16 when an employee, who was working underneath a raised hopper, was struck and injured by the hopper as a result of the hopper's unexpected release of stored energy. The hopper was not isolated from falling. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
