29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc.     a) On or about September 15, 2016, CJ Materials & Recycling LLC did not provide guardrails to protect employees from falls of approximately 11 feet when working from the top of a concrete crushing machine.     In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:     a)  On or about September 15, 2016, CJ Materials & Recycling LLC did not establish a program consisting of an energy control procedure, employee training, and periodic inspections when an employee performed servicing of the XA400S Powerscreen Crusher during the manual breaking down of large concrete pieces into smaller pieces and clearing debris, including rebar, from near the equipment's point-of-operation, the jaw crusher, while standing on the feed conveyor.      In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
