29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electric shock, were not protected by protective hardhats:      a)  An employee was exposed to head injury working without a hardhat when standing on a ladder welding  steel beams that support the excavation sheeting system.       Location: 2107 Ditmas Ave, Brooklyn, N.Y.      On or about 9/21/2016      NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1):  When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least three feet above the upper landing surface; or, when such an extension is not possible because of the ladder's length, the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device such as a grab-rail was not provided:      a)   Employees were exposed to fall hazard when using two ladders to go in and out of the 15 ft deep excavation; the ladders did not extend 3 feet above the top of the excavation and were not otherwise secured.      Location: 2107 Ditmas Ave, Brooklyn, N.Y.      On or about 9/21/2016       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
