OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious struck/hit by injuries or death from falling limbs. JOBSITE: The employer did not ensure through establishing a work plan for safe drop zone and proper ways of communications or visual observation that the employees engaged in tree trimming task and removal from the aloft basket and ground were performing the tasks safely at all times. On or about September 09, 2016, the employee collecting felled limbs and feeding the waste into the wood chipper from the ground was hit by a falling branch, and the employee sustained serious multiple injuries fro the incident.
