OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards created by damaged racking systems: a) 173 Belmont Drive, Somerset, NJ site - Warehouse Center Aisle: Employees were exposed to struck by hazards of collapsing racks of the metal storage racking system while the employees warehoused materials. Industrial steel storage racks which were bent or damaged and were used to for storage of pallets containing various sized containers of chemicals and other supplies. Racking system had damage to several stanchions. Condition noted on or about 9/21/2016.

29 CFR 1910.22(a)(3): Floors, working places, and passageways were not kept free from protruding nails, splinters, holes, or loose boards. a) 173 Belmont Drive, Somerset, NJ site - Warehouse Center: Warehouse floors were not kept free from holes and loose boards. The employer did not maintain warehouse floors that had holes large enough to step into and large enough for forklift tires to become lodged when employees operated the forklifts on the loading docks. Condition noted on or about 9/21/2016.
