OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat while working with horses both inside and outside of the barns while performing tasks, such as cleaning stalls, leading horses to the walker, and twitching horses:    (a) Hanover Shoe Farms, Inc.; Fairgrounds Barn, 451 Eagle Avenue, Hanover, Pennsylvania - On or about September 9, 2016, an employee was hospitalized for heat exhaustion after working in Barn Number 4 while standing and twitching a horse. The employee was exposed to excessive heat with a peak heat index of 95 degrees Fahrenheit.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1904.29(b)(3): Each recordable injury or illness was not entered on the OSHA 300 Log and on an incident report (OSHA Form 301or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness had occurred:    (a) Hanover Shoe Farms, Inc.- The employer did not enter a recordable heat stress case that occurred on or about September 9, 2016 on the OSHA 300 log within seven calendar days of receiving information that a recordable illness had occurred, on or about September 22, 2016.     No abatement certification or documentation required.
