29 CFR 1910.178(l)(4)(ii)(B): The operator has been involved in an accident or near-miss incident; (a) On or about June 27, 2016, The employer did not ensure that refresher training and evaluation had been conducted for a Powered Industrial Truck (Speeder) Operator, that was involved in a near-miss incident involving a pedestrian. The incident occurred three months prior to the opening conference of this inspection and no required training had been accomplished to that date. Abatement certification for this violation is not required.
