OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were permitted to operate forklifts without the use of seatbelts: (a) Warehouse and Yard Area: On September 27, 2016, and times prior, employees were permitted to operate the Doosan forklift (model #G25S-3, serial #99-00953) that was not equipped with a seatbelt, exposing employees to crushing injuries associated with rollover hazards. (b) Warehouse and Yard Area: On September 27, 2016, and times prior, employees were permitted to operate the Daewoo forklift (model #G30S-2, serial #12-00619) that was not equipped with a seatbelt, exposing employees to crushing injuries associated with rollover hazards.

29 CFR 1910.24(b): Fixed stairs were not provided for access from one structure level to another where operations necessitated regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations: (a) Consumable Items Storage: On September 26, 2016 and times prior, employees access the consumable items storage area multiple times daily. Employees access the area that is 3 feet 5 inches above ground level by using a job made wooden ladder that did not have uniform step spacing.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Facility Wide: On September 26, 2016 and times prior, employees operated a Daewoo LP forklift (model #G30S-2, serial #12-00619) and a Doosan LP forklift (model #G25S-3, serial #99-00953) to move roofing materials throughout the warehouse and yard area. The employer has not instituted a powered industrial truck training program that included formal instructions, practical demonstrations of competence, and evaluation of the operators performance in the workplace ensure that forklift operators are competent to operate the forklift safely.
