OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards. a. On or about September 24, at the above addressed jobsite, employees were in the process of jumping a double car skip hoist elevator. Two employees were working on top of car #115 when another employee operating car #116 traversed up the building, resulting in the counterweight of car #116 to travel down the tower mast. An employee was positioned on car #115 in the path of the moving counterweight and was struck, resulting in the amputation of an arm.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. On or about September 24, 2016, at the above addressed jobsite, an employee was struck by the elevator counterweight while performing jumping operations on a personnel hoist (skip hoist). The employer had not provided training to employees in the recognition and avoidance of an unsafe condition with multiple cars that have off-set top floors that exposed employees to the counterweight that created a struck by hazard.
