29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:    a) On or about September 27, 2016, and dates prior, at a worksite located at 901 NW Platte Valley Drive, Riverside, Missouri, the employer failed to conduct an evaluation of each powered industrial truck operator's performance at least every three years. Employees were exposed to serious struck-by hazards during operation of nine Toyota model 8FGCU25 Powered Industrial Trucks (PITs).    Abatement certification for this violation is not required.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    a) On or about September 27, 2016 and dates prior, at a worksite located at 901 NW Platte Valley Drive, Riverside, Missouri, the employer failed to remove power-operated industrial truck(s) not in safe operating condition from service. Employees were exposed to serious struck-by, electric shock, and fire hazards.    1)  On dates preceding September 19, 2016, Toyota model 8FGCU25, FT61, S/N 48358, was operated with a burned out brake light.    2)  On dates preceding September 19, 2016, Toyota model 8FGCU25, FT60 S/N 48422, was operated with a worn/damaged brake pedal pad, burned out brake light, and frayed seat belt.    3)  On dates preceding September 19, 2016, Toyota model 8FGCU25, FT56, S/N 48450, was operated with worn drive tires, worn/damaged parking brake pedal pad, burned out brake light, and damaged fork pins.    4)  On dates preceding September 20, 2016, Toyota model 8FGCU25, FT62, S/N 48359, was operated with damaged steer tires, a worn/damaged brake pedal pad, damaged headlight brackets, and a missing side mirror.    5)  On dates preceding September 20, 2016, Toyota model 8FGCU25, FT57, S/N 48433, was operated with brakes needing adjustment, and a burned out brake light.    6)  On dates preceding September 20, 2016, Toyota model 8FGCU25, FT53, S/N 48470, was operated with brakes needing adjustment and a missing side mirror.    7)  On dates preceding September 20, 2016, Toyota model 8FGCU25, FT59, S/N 48399, was operated with the mast hoses at incorrect tension, requiring adjustment.    Abatement certification for this violation is not required.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees, in that the employer did not ensure the safety of the equipment pursuant to the considerations in sections (i) through (viii) of 29 CR 1910.303(b)(1):    a)  On and dates preceding September 27, 2016, at a worksite located at 901 NW Platte Valley Drive, Riverside, Missouri, employees jump-started multiple Toyota model 8FGCU25 fork trucks using jumper cables personally owned by the warehouse manager and by individual employees. The set of jumper cables in use on September 27, 2016 was observed to have damaged insulation and frayed and exposed wiring. Employees were exposed to electric shock and burn hazards.    Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
