29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by a "competent person" prior to the start of work and as needed throughout the shift: (a) Next Generation Construction and Environmental, LLC, 13651 Syracuse, Thornton, CO: On or about September 26, 2016, the employer did not ensure a "competent person" conducted an inspection of the 12 foot deep vertical wall excavation to ensure an appropriate protective system was installed prior to entry. An employee entered the unprotected excavation to locate an existing 4 inch plastic sewer line. This condition exposed the employee to crushing hazards associated with cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Next Generation Construction and Environmental, LLC, 13651 Syracuse, Thornton, CO: On or about September 26th, 2016, the employer did not ensure an employee who entered an excavation for the purpose of locating an existing 4 inch plastic sewer pipe was protected from cave-in hazards. The 12 foot deep excavation with a vertical wall excavation was not sloped, shored, sheeted, and no trench box was in use. This condition exposed the employee to crushing hazards associated with cave-in hazards.
