29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about 9/19/2016 in the loading area, where prior to allowing the operator involved in a struck-by accident to continue to operate the powered industrial trucks, the employer failed to re-train the operator that was observed operating the powered industrial truck during the investigation.

29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about 9/27/2016 in the loading area, the operator of a powered industrial truck was observed not looking in the direction of travel while backing. Employees in the area were exposed to a struck by hazard.
