On or about September 28, 2016, employer's subcontractor employee on the 5:12 pitch roof, operated a pneumatic nailer to attach roof sheathing without the use of eye protection, being exposed to struck-by nails and flying debris.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a. On or about September 28, 2016, general manager, foreman and employees installing floor decking on the second level with unprotected side between the truss/wall studs without the use of any fall protection systems, being exposed to a 14-foot fall hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a. On or about September 28, 2016, the employer's subcontractor crew leader and employee used the 2 section aluminum extension ladder that did not extend 3 feet above the block wall top plate when they accessed the roof trusses to attach the roof sheathing, being exposed to a 13 feet 8-inch fall hazard.
