29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:    a) Site - On or about 09/29/16 and at times prior thereto employees engaged in roofing work including (but not limited to) the rolling down, spraying, and welding of thermoplastic membranes (by hand and with a Varimat V machine) were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Employees were exposed to falls from a 29 ft. elevation onto the concrete floor in the surroundings of the building.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.502(f)(1)(ii): 29 CFR 1926.502(f)(1)(ii):  When mechanical equipment was being used, the warning line was not erected at least 6 feet (1.8 m) from the roof edge which is parallel to the direction of mechanical equipment operation, and at least 10 feet (3.1 m) from the roof edge which is perpendicular to the direction of mechanical equipment operation.  a) Site - On or about 09/29/16 and at times prior thereto employees engaged in roofing work operated a Varimat V machine for welding thermoplastic membranes. The warning line was erected at 6.0 ft. (instead of at least 10.0 ft.) from the roof edge which was perpendicular to the direction of  the Varimat V machine operation.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) GPS National, Inc. - At 01:50 PM on 09/26/16 an employee fell off the roof from a 29 ft. elevation onto the concrete floor and died. The employer failed to report the fatality within eight hours. OSHA was notified at 01:20 PM on 09/28/16.   No abatement action is required for this item.
