29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 9 N 31st St., Longport, NJ: On or about 9/28/2016 a V&E General Construction Inc. employee was installing siding from an unguarded second floor deck of a three story new construction residential structure. The employee was not using any form of fall protection and was exposed to a fall hazard of 19.5 feet to the ground below. b) N 31st St., Longport, NJ: On or about 9/28/2016 a V&E General Construction Inc. employee was installing siding from an steep sloped roof of a three story new construction residential structure. The employee was not using any form of fall protection and was exposed to a fall hazard of greater than 25 feet from the roof's eve to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. a) 9 N 31st St., Longport, NJ: On or about 9/28/2016 two V&E General Construction Inc. employees were installing siding on a three story new construction residential structure. The employees were not using any form of fall protection and were exposed to a fall hazards from 19.5 to greater than 25 feet to the ground below. The employer had not trained each employee to recognize the hazards of falling and the procedures to follow to minimize the hazards. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
