29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. (a) New residential construction located on Lot #91, Roof trusses: On or about October 3, 2016, and at times prior, the employer exposed employees to eye injuries while operating Hitachi (Model NR83AS1) Pneumatic Nail Guns at 120 PSI, in that protective eyewear was not provided to employees installing trusses and plywood sheathing. Sandoval Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 898738, citation number 1, item number 1 and was affirmed as a final order on 07/10/2013, with respect to a workplace located at 522 Micayne Circle, Smyrna, GA 30082.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction on Lot #91, Second floor deck: On or about October 3, 2016, and at times prior, the employer exposed employees to fall hazards of 23-feet, 7-inches to the lower level, in that the employees using the second floor as a walking/working surface engaged in cutting plywood was not provided with a guardrail system or other fall protection system. (b) New residential construction on Lot #91, Roof trusses: On or about October 3, 2016, and at times prior, the employer exposed employees to fall hazards of approximately 31-feet, 7-inches to the lower level, in that employees working from the roof trusses and the sheathed roof were not provided with a fall protection system and were not protected from falls to the lower level. Sandoval Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1118055, citation number 1, item number 1 and was affirmed as a final order on 05/31/2016, with respect to a workplace located at 140 Prospect Street, Lot #4, Marietta, GA.
