29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 4 October 2016, and at times prior thereto, three stucco workers were performing work on a scaffold without hard hats while there were overhead activities, exposing the workers to the hazard of being struck by falling debris, materials or tools.

29 CFR 1926.451(h)(2)(ii): A toe-board was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below. On or about 4 October 2016, and at times prior thereto, three workers were performing stucco work on a scaffold without the use of toe-boards, exposing the workers to the hazard of being struck by falling debris, materials or tools.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and braces were not installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less. The top guy, tie or brace of completed scaffolds were not placed no further than the 4:1 height from the top. Such guys, ties and braces were not installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other). On or about 4 October 2016, and at times prior thereto, three stucco workers were performing work from a scaffold that was 5 tiers high and 8 sections across without being tied in to the building on each end and at least every 30 feet horizontally, exposing the workers to a fall hazard of approximately 21 feet to the ground below.
