29 CFR 1926.302(b)(3): All pneumatically driven nailers, staplers, and other similar equipment provided with automatic fastener feed, which operate at more than 100 p.s.i. pressure at the tool shall have a safety device on the muzzle to prevent the tool from ejecting fasteners, unless the muzzle is in contact with the work surface.  On or about October 5, 2016, employees were exposed to being struck by flying objects.  The employees were framing a newly constructed residential home located in Strongsville, Ohio 44136. The employees were using an air powered nail gun that had a safety device that was frozen in the open position and did not prevent fasteners from ejecting.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about October 5, 2016, employees were exposed to a fall of approximately 10 feet.  The employees were framing a newly constructed residential home located in Strongsville, Ohio 44136. The employees were installing floor joists on the 2nd floor.  The employees were not using any form of fall protection.
