29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:     On or about October 5, 2016, during the replacement of a sanitary sewer line at approximately 2144 Atkins Avenue, Lakewood, Ohio, the employer did not ensure an employee working inside a trench, at a depth of approximately 7 feet and with near 90 degree vertical walls, was protected from cave-ins by an adequately designed protection system.  The soil was classified as; Cohesive Soil made up of angular gravel that was previously disturbed, type B.        BROADWAY EXCAVATING, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1163168, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON OR ABOUT AUGUST 16, 2016, WITH RESPECT TO A WORK PLACE LOCATED AT 16613 DELAWARE ROAD, LAKEWOOD, OHIO.
