29 CFR 1926.102(a)(1): Eye and face protective equipment was not used when machines or operations presented potential eye or face injury: On or about October 5, 2016 at the above addressed jobsite, employees were using a pneumatic nail gun and were not wearing safety glasses, thereby exposing employees to the hazards associated with eye injuries. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about October 5, 2016 at the above addressed jobsite, employees were performing carpentry work on a new residential townhome. Employees were not utilizing fall protection and were exposed to a fall hazard of approximately 10.0-10.8 feet. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d). Jorge Ramirez, dba Fry Installations Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(1), which was contained in OSHA inspection number 1056140, citation number 1, item number 1 and was affirmed as a final order on May 5, 2015 with respect to a workplace located at 8 West North Ave., Villa Park, IL 60181.
