29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazards) (a)Hawk Construction, LLC at 4601 Louise Ave., Sioux Falls SD, 57106: On and prior to September 27, 2016, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. One employee was working to install a top plate on a wall of a commercial building from the forks of a rough terrain forklift. The employee was not protected from fall hazards while standing on the forks of the forklift. This condition exposed an employee to a fall hazard of approximately 12 feet to the ground below. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. (a)Hawk Construction, LLC at 4601 Louise Ave., Sioux Falls SD, 57106: On and prior to September 27, 2016, the exposing employer did not ensure that employees were protected from a fall from elevation, in that, guardrails or other suitable fall protection were not properly utilized in conjunction with the use of rough terrain forklift. An employee was standing on the forks of the lift attempting to install a top plate on a wall of a commercial building. This condition exposed an employee to a fall hazard of approximately 12 feet to the ground below.
