29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) Jobsite, 243 Rubisch Road , Ebensburg, PA: On or about October 4th 2016, during explosive cleaning activities, the employer did that ensure that an adequate assessment was done of the area in order to ensure that employees were equipped with the proper personal protective equipment (PPE) for the hazards associated to the work environment. An uncontrolled denotation lead to a blast and secondary deflagration resulting in 2nd and 3rd degree burns to three employees on their face, hands and torso.

29 CFR 1910.269(v)(11)(xii): Where coal-handling operations may produce a combustible atmosphere from fuel sources or from flammable gases or dust, sources of ignition shall be eliminated or safely controlled to prevent ignition of the combustible atmosphere: (a) Facility, 243 Rubisch Road, Ebensburg, PA: On or about October 4, 2016 the employer did not eliminate or control an ignition source when having maintenance performed in the 9th level refuse fuel bunker. The employer did not ensure that the area had been wet down or other cleaning methods conducted to reduce any dust that has the potential to be shaken up and create a combustible atmosphere. The employer used explosive materials in an attempt to loosen material stuck inside the section of the refuse bin and an explosion occurred.
