29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee used the respirator in the workplace(Construction Reference 1926.103):      a.)   Central Heating & Plumbing Company, Inc., 660 Fisher Hill St, Sharon, PA  16146, on or about October 5, 2016 and times prior thereto:  An employee voluntarily wore a half mask air-purifying respirator (Miller brand LPR-100 series with P100 cartridges) during cutting/grinding operations of cast iron metal pipes onsite.  The employee was not provided with a medical evaluation prior to the use of the half mask filtering facepiece respirator.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  (Construction Reference 1926.103)(a)    a.)   Central Heating & Plumbing Company, Inc., 660 Fisher Hill St, Sharon, PA  16146, on or about October 5, 2016 and times prior thereto:  An employee voluntarily wore a half mask air-purifying respirator (Miller brand LPR-100 series with P100 cartridges) during cutting/grinding operations of cast iron metal pipes onsite.  The employer did not establish a site specific Respiratory Protection Program that covered medical evaluations for employees who voluntarily wore half mask air-purifying respirators.

Central Heating & Plumbing Company, Inc., 660 Fisher Hill St, Sharon, PA  16146, on or about October 5, 2016 and times prior thereto:  An employee voluntarily wore a half mask air-purifying respirator (Miller brand LPR-100 series with P100 cartridges) during cutting/grinding operations of cast iron metal pipes onsite.  Employees that voluntarily used half mask respirators were not provided with the information in Appendix D to this section.
