OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from a struck-by hazard from a load while being underneath a suspended load. On September 29, 2016, in the Maintenance Building, an employee was exposed to a struck-by hazard from being underneath a suspended load, a 350 lb. torque converter, was being lifted up and installed on a D6 Caterpillar. Among other methods, one feasible and acceptable method to correct this hazard is to follow American Society of Mechanical Engineers (ASME) B30.16-2012, Overhead Hoists (Underhung), Section 16-3.3.2, General Requirements to be Followed During Hoist Operation, item (i) wherein it specifies that persons shall stay clear of a suspended load.

29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. A 1/4 ton come-along, owned by the Maintenance Supervisor, was used on September 29,2016 with another 1/4 ton come-along to help raise a 350 lb. torque converter so as to install on a D6 Caterpillar bulldozer and was missing the safety latch on the hook attached to a 1 ton Jet manual hoist.
