29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely: (a) MVC - The employer did not provide refresher training and an evaluation of the effectiveness of that training to each powered industrial truck operator involved in an accident or near-miss incident, including to an operator who pushed a skid of hub caps off a metal storage rack while putting away materials in the storage rack on the opposite side, exposing employees who worked in the aisleways below the storage racks to the hazard of getting struck-by falling pallets/skids of motorcycle parts/assemblies, on or about August 28, 2016. Corrected during the inspection.
