29 CFR 1910.134(d)(1)(iii) (as referenced by 29 CFR 1926.103): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. a) On or about October 6, 2016 or prior there to: The employer was dry cutting Lions Pride Flagstone during the installation of planters at a residence. During this operation, employees were exposed to dust which contained respirable silica as the Flagstone product was estimated to contain 70 to 80% silica per OSHA bulk sampling analysis. Employees were exposed to the hazard of crystalline silica, and an airborne assessment of respirable dust containing silica had not been conducted. NOTE: Abatement documentation and certification are required for this item.
