29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) Roof, 143 Mahanoy Avenue, Tamaqua, PA - Roofing repairs were performed on a flat roof around seven (7) holes (skylights) that were not protected by covers or erected guardrail systems exposing employees working without personal fall arrest systems to fall hazards up to twenty three-foot, eight inches (23'8") above a concrete floor, on or about October 6, 2016.  In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  a) Roof, 143 Mahanoy Avenue, Tamaqua, PA - Roofing debris from roofing work was collected and transported by wheelbarrow on a north-south running plywood pathway with unprotected edges along the western side and at the southern end exposing employees to a fall hazard of twenty two-foot, eight inches (22'8") above concrete and asphalt, on or about October 6, 2016.  In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  a) Roof, 143 Mahanoy Avenue, Tamaqua, PA - A member of a team of employees engaged in roof removal/replacement of a flat roof fell through a skylight. The team of employees had not been provided a training program on fall protection, were not trained to recognize the hazards of falling, and were not familiar with procedures that could be followed to minimize fall hazards during the performance of roofing work thereby exposing the employees to fall hazards up to twenty three-foot, eight-inches (23'8") above concrete or asphalt, on or about October 6, 2016.  In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.

29 CFR 1910.23(e)(2): Stair rails did not consist of a top rail, intermediate rail and/or posts, with the vertical height not more than 34 inches (86.36 cm) nor less than 30 inches (76.2 cm) from upper surface of top rail to surface of tread in line with face of riser at forward edge of tread.   a) Roof, 143 Mahanoy Avenue, Tamaqua, PA - The top rails of a dark gray set of fixed stairs had a vertical height of  twenty-inches (20") from the upper surface of the top rails to the surface of a roof platform (top riser) exposing employees that used the fixed stairs daily for roof access/egress to slip, trip, and fall hazards, on or about October 6, 2016.
