OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operated a powered industrial truck without a seat belt installed or restraint device. On or about 10/11/16 at 6670 Corners Industrial Court, Norcross, GA: Where an employee operated the Yale powered industrial truck to lift and move material equipment that was not equipped with a seat belt or restraint device. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): On or about 10/11/16 in the Maintenance Shop at 6670 Corners Industrial Court, Norcross, GA: Authorized employees were performing service and or maintenance on the facility trucks, vans, cars, and powered industrial trucks such as but not limited to inspections, engine removal and brakes, electrical, and other repairs, which contained electrical, hydraulic, gravity energy sources. The employer failed to develop specific written energy control procedures.

The employer failed to remove the powered industrial truck from service until the repairs could be made.
