On or about 8 October 2016, and at times prior thereto, two workers were replacing a damaged concrete culvert with a corrugated poly pipe that was within 3 to 4 feet of the edge of a lake without a ring buoy for emergency rescue, exposing the workers to a drowning hazard.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit. On or about 8 October 2016, and at times prior thereto, the employer did not ascertain at the work site whether the electrical wire running across the culvert or pipe was energized during the performance of work, exposing the workers to an electrical hazard. Various job tools used included hand-held saws, a sledgehammer, and a wheelbarrow.
