29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On 10/05/2016, employees from W & Z Contracting Construction, LLC were replacing shingles on a roof of a residence located at 600 Capri Way, St. Peters, MO. They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. The crew leader and four employees were observed on the roof of the building without fall protection, exposing them to a fall to the ground below. Wilmer Gutierrez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 998918, citation number 1, item number 2 and was affirmed as a final order on 11/13/2014, with respect to a workplace located at 7202 Gadwall Way, OFallon MO.
