OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe lacerations while drop starting chainsaws in preparation of performing tree trimming operations:     (a) Martin Avenue:  On or about October 6, 2016 and times prior an employee operating a Stihl MS 170 chainsaw with a 12in. bar and a Jonsered CS 2255 chainsaw with a 20in. bar was drop starting the chainsaw prior to performing tree trimming operations such as cutting trees down, cutting limbs, cutting logs, and cutting brush.

(a) Martin Avenue:  On or about October 6, 2016 and times prior an employee was exposed to a fall of up to 20ft. while trimming a tree without the use of a fall protection system.   (b) Martin Avenue:  On or about October 6, 2016 and times prior an employee used a Stihl MS 170 chainsaw with a 12in. bar and a Jonsered CS 2255 chainsaw with a 20in. bar to remove limbs from a tree without the use of cut-resistant leg protection.

(b) Martin Avenue:  On or about October 6, 2016 and times prior a Jonsered CS 2255 chainsaw with a 20in. bar was in use without an operable chain brake.  (c) Martin Avenue:  On or about October 6, 2016 and times prior a 100ft. French Creek Production 5/8in. rope with snap hook and thimble ends was used to lower and guide limbs out of a tree was damaged and remained in use.
