OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards as the result of two dust collection systems handling combustible metal dusts which were not designed and installed to minimize exposure in the event of a deflagration, explosion, or other uncontrolled fire event:    a) Outside of the Plating Room, on or about October, 13 2016 - All components of the two AAF International Optiflo RC dust collectors and the associated duct work were not bonded and grounded.    b) Outside of the Plating Room, on or about October 13, 2016 - Two AAF International Optiflo RC dust collectors were not provided with explosion protection. Employees work adjacent to the dust collectors in the Plating Room.    c) In the Polish Room and Aluminum Polish Room, on or about October 13, 2016 - Exhaust air from both AAF International Optiflo RC dust collectors was recycled back into the Polish Room and Aluminum Polish Room.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels:    a) In the Polish Room, on or about November 8, 2016 - The employer failed to obtain an annual audiogram for a polisher who was exposed to noise at an 8-hour time-weighted average of 88.9 decibels. Employees received audiograms from Apple Mobile Medical in June 2009.    b) In the Polish Room, on or about November 8, 2016 - The employer failed to obtain an annual audiogram for a polisher who was exposed to noise at an 8-hour time-weighted average of 94.6 decibels. Employees received audiograms from Apple Mobile Medical in June 2009.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of copper dust listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 1 mg/m3:      a) In the Polish Room, on or about November 8, 2016 - A Polisher was exposed to copper dust at a time weighted average exposure of 1.22 mg/m3.  This level is 1.22 times the permissible exposure limit of 1 mg/m3 as a time weighted average concentration.  Sampling was performed by an OSHA compliance officer on November 8, 2016 for 456 minutes and zero exposure was assumed for the unsampled portion of the shift.
