29 CFR 1926.416(a)(1): The employer did not ensure that: No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit during the course of work unless the employee is protected against electric shock by de-energizing the circuit and grounding it or by guarding it effectively by insulation or other means: a) Employees were working in energized electric panels DPH-40B-2 and 40-B-4 and were not protected by using electrical PPE or insulating devices. On or about 10/08/2016 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.416(b)(1): The employer did not ensure that barriers or other means of guarding shall be provided to assure that work space for electrical equipment will not be used as a passageway during periods when energized parts of electric equipment are exposed: a) The employer did not have the aisle/work area barricaded to keep passageway clear when energized electric panels DPH-40B-2 and 40-B-4 were being worked in. An arc flash occurred while work was being done in the energized panels. Location: 388 Greenwich St, New York, N.Y., 40th fl mechanical rm. On or about 10/08/2016 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
