29 CFR 1910.36(b)(2): More than two exit routes were not available in the workplace where the number of employees, the size of the building, its occupancy, or the arrangement of the workplace was such that all employees would not be able to evacuate safely during an emergency: a) Aramids Phosgene unit 1074 second level: Only one exit was available from the second level preventing employees from evacuating safely during an emergency, on or about 10/14/16. b) Aramids Phosgene unit 1074 third level: The two exit routes from the third level discharged next to the processing equipment, including the mixing tee, reactor one and vaporizer, on or about 10/14/16. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.119(f)(1)(iii)(B): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information that addressed health and safety considerations, such as precautions necessary to prevent exposure, including engineering controls, administrative controls, and personal protective equipment: a) Aramids Phosgene unit 1074: The employer did not implement their written operating procedures for line breaks, Chambers Works Safety How Chapter K-33, when they failed to include the use of an elephant trunk vacuum system at the point of a line break on process equipment containing phosgene. A contractor working in the building, in the vicinity of the operation involving the line break, was exposed to phosgene resulting in observation at a hospital, on or about 10/13/16. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

E.I. DuPont DeNemours Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.119(l)(1), which was contained in OSHA inspection number 977053, citation number 1, item number 4 and was affirmed as a final order on 3/28/16, with respect to a workplace located at 3460 Highway 44 Darrow Louisiana 70725.
