Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a) Yesco LLC, dba Yesco Custom Electric Signs, at 11220 E 53rd Avenue, Denver, CO: On 10/12/16, Yesco LLC did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. Employees were removing the man basket of a Manitowoc model 26101 truck mounted crane. The operation took place at the warehouse yard, which was not lit. The parking lot and immediate surroundings had no lighting. This condition exposed employees to a struck-by hazard. (b) Yesco LLC, dba Yesco Custom Electric Signs, at 11220 E 53rd Avenue, Denver, CO: On 10/12/16, Yesco LLC did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. Employees were removing the man basket of a Manitowoc model 26101 truck mounted crane. The position of the crane operator console provided an obstructed view of the rear of the truck mounted crane, where his assistant was located. Unauthorized personnel were not kept clear of the truck mounted crane during deployment of the outriggers. This condition exposed an employee to a struck-by hazard.

Employees were removing the man basket of a Manitowoc model 26101 truck mounted crane. The operation took place at the warehouse yard, which was not lit. The parking lot and immediate surroundings had no lighting. The employer did not ensure that employees used traffic vests while working in the dark yard. This condition exposed employees to a struck-by hazard.

29 CFR 1910.180(d)(3)(iii): The employer did not ensure that all safety devices were inspected for defects at intervals as defined in paragraph (d)(2)(i) of this section: (a) Yesco LLC, dba Yesco Custom Electric Signs, at 11220 E 53rd Avenue, Denver, CO: On and prior to 10/12/16, Yesco LLC did not ensure that all safety devices were inspected for defects at intervals as defined in paragraph (d)(2)(i) of this section. Employees were removing the man basket of a Manitowoc model 26101 truck mounted crane. The alarm signal to notify employees of the deployment of the outriggers was disabled. An employee's foot was crushed during deployment of the passenger side rear outrigger. The alarm had been covered by duct tape and was inaudible. The employer's frequent inspections of the truck mounted crane had not addressed the disabled alarm. This condition exposed the employee to an amputation hazard.
