Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to vehicle struck-by hazard while flagging traffic and not wearing a reflective vest and not having warning signs to alert vehicle operators of the jobsite. Madison Avenue, between N. Castle Drive and Castle Circle - On or about October 14, 2016 an employee was exposed to the following vehicle struck-by hazards: a. On or about October 14, 2016 an employee was directing vehicle traffic without wearing high visibility clothing or a Class 2 or 3 reflective vest. b. On or about October 14, 2016 the employer parked a bucket truck in the oncoming traffic lane of a narrow two lane roadway while cutting tree branches. The employer did not post warning signs to warn vehicle operators of the job site.
