29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. a. On or about 10/26/16 at the workplace, employees performing tanker cleaning operations and air monitoring were exposed to an engulfment hazard while standing next to an unguarded waste collection pit. The pit contained a hydraulic fracturing mud waste product and water.

29 CFR 1910.146(d)(5)(ii): Test or monitor the permit space as necessary to determine if acceptable entry conditions are being maintained during the course of entry operations; and a. On or about 10/09/2016, an employee performing cleaning operations inside of a tanker truck was exposed to an atmosphere within a confined space that was not monitored sufficiently to determine if acceptable entry conditions were maintained. The atmosphere at the bottom of the tanker was monitored by an attendant but the upper area of the tanker, the employee's breathing zone, was not.

29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign. a. At the workplace, the employer did not post signs on the outside of tanker trucks brought in for cleaning, indicating the presence of the permit-required confined spaces within them.
