OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment free from recognized hazards causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and/or struck-by hazards: On or about October 18, 2016, employees were allowed to park side by side as they unloaded excavation material at a private construction and debris landfill with end dump trailers that had one or more liners in disrepair, preventing the material from sliding out and thus creating an imbalanced load which created the potential for the trailer to tip over onto the adjacent truck cab or to tip over the cab of the truck pulling the imbalanced trailer.
