OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard. On or about October 19, 2016 Location: North East corner of the residential house a) An Employee was exposed to a fall hazard while getting on and off the roof. The ladder did not extend 3 feet above the gutter;a deviation from the standard industry practice (ANSI A14.5, section 9.3.10) and the ladder manufacturer's recommendations. b) The top cap and top step were used as steps.

29 CFR 1910.132(a): Protective equipment, such as fall protection safety equipment, as was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about: 10/19/2016 LOCATION: the North East roof area of the house,59 Winding Ridge Rd, White Plains NY 10601 a) The company owner and employee working on a residential house roof; power washing on a 12:12 ratio sloped roof without personal fall protection. The steeply sloped roof increased the exposure to a fall hazard of approx. 9 feet 5 inches; measured from the gutter to the ground.
