OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tripping hazards. (a) In Building 400 near the base of the job-made ladder, on or about and at times preceding to October 17, 2016, concrete bolts were protruding 3 inches above the walking surface, exposing workers to tripping hazards.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways: (a) In Building #400 at the job-made ladder, on or about and at times preceding to October 17, 2016, employees had not been trained on safe ladder use, including information about the importance of facing the ladder and maintaining 3-point contact when ascending or descending the ladder.
