29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On October 20, 2016, employees were working in the Hickory Point Lift Station excavation with water draining through the openings in the shield system and the employer did not remove the water pressure from the sides of the excavation to the level specified in the shoring design plan prior to entering the excavation and during the work.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) and (c). a. On October 20, 2016, employees working in the Hickory Point Lift Station excavation were exposed to struck by hazards from the soil and rock on the north side of the shoring system after the shoring was pushed down and the remaining soil and rocks were not protected with a suitable means. b. On October 20, 2016, employees working in the Hickory Point Lift Station excavation were exposed to hazards after a large steel plate was welded onto the southeast side of the shoring system to prevent soil from entering from the bottom of the excavation and the addition was not approved by a registered professional engineer.
