29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59):    On or about October 20, 2016, at 1137 Brookhaven Walk Way, Brookhaven, Georgia:    Five employees performing brick masonry work were exposed to lung irritation and eye and skin burns while working with Argos Type N Mortar which contains chemicals which include but are not limited to Portland cement when the employer did not develop and implement a written hazard communication program to instruct the employees how to recognize and minimize the hazards of working with the mortar.

29 CFR 1910.1200(g)(8): 1910.1200(g)(8):   The employer did not ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in their work area(s): (Construction Reference: 1926.59):    On or about October 20, 2016, at 1137 Brookhaven Walk Way, Brookhaven, Georgia:    Five employees performing brick masonry work were exposed to lung irritation and eye and skin burns while working with Argos Type N Mortar which contains chemicals which include but are not limited to Portland cement when the employer did not keep copies of the Safety Data Sheets on the jobsite for the employees to be informed how to recognize and minimize the hazards of working with the mortar.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 20, 2016, at 1137 Brookhaven Walk Way, Brookhaven, Georgia:  a) Five employees performing brick masonry work were exposed to burns to their eyes while working with Argos Type N Mortar when they did not use eye protection.   b) Four employees performing brick masonry work were exposed to struck-by hazards from brick shards while chipping bricks with their trowels when they did not use eye protection.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about October 20, 2016, at 1137 Brookhaven Walk Way, Brookhaven, Georgia:  Four employees performing brick masonry work were exposed to a fall hazard of approximately 25-feet and greater while climbing  up and down the scaffold frame when the employer did not install a ladder.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  On or about October 20, 2016, at 1137 Brookhaven Walk Way, Brookhaven, Georgia:  An employee performing brick masonry work was exposed to struck-by hazards from falling bricks, mortar buckets, trowels, and a wheelbarrow, from the employees working above him from a scaffold while he worked from the ground below them when the employer did not install toe boards on the work level of the fabricated frame scaffold.
