29 CFR 1910.1200(e)(1): Employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a)  Allied Construction Management, Inc., at 425 W Prospect Road, Fort Collins, CO 80526: On and preceding 10/21/16,  the employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f) and (g) of this section for labels and other forms of warning, and safety data sheets will be met.  Employees performed carpentry and drywall demolition tasks, including jack-hammering cement foundations.  The employer had not developed a written hazard communication program with regards to hazardous chemicals in their work area, including silica dust hazards.

This condition exposed employees to chemical hazards and respiratory hazards during cement breaking operations for hotel renovation.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a)        Allied Construction Management, Inc. at 425 W Prospect, Fort Collins CO 80526: On or before 10/21/16, the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations.  Four employees were directly involved in removing cement foundations with jack hammers.  Employees had significant facial hair and were wearing disposable half mask HEPA respirators.  The employer did not have a written respiratory protection program.  This condition potentially exposed the employees to a respiratory hazard.  Abatement Note: A written respiratory protection program should include at a minimum:      1)    A written program;     2)    Proper selection of respirators;     3)    Medical Evaluation for respirator users;     4)    Fit-testing for respirator users;     5)    Procedures for the proper use of respirators;     6)    Maintenance and care of respirators;     7)    Identification of filters;     8)    Training and information for employees;     9)    Program evaluation; and     10)  Recordkeeping

29 CFR 1910.134(k)(3): Training was not provided prior to requiring employees to use a respirator in the workplace:  (Construction Reference 1926.103)   (a)  Allied Construction Management, Inc. at 425 W Prospect Fort Collins, CO 80526: On and preceding 10/21/16, the employer did not provide training to employees wearing a respirator.  Employees allowed to wear respiratory protection with facial hair present when conducting silica dust operations.  This condition potentially exposed the employees to a respiratory hazard.   Abatement Note:  The requirements applicable to construction work under 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.    Abatement Note:  The employer shall ensure that each employee can demonstrate knowledge of at least the following:    (1)        Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator;    (2)        What the limitations and capabilities of the respirator are;    (3)        How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions;    (4)        How to inspect, put on and remove, use, and check the seals of the respirator;    (5)        What the procedures are for maintenance and storage of the respirator;    (6)        How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators; and    (7)        The general requirements of this section.
