29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) YRC Freight - On or about October 20, 2016, the employer failed to ensure that a Toyota powered industrial truck which was not in a safe operating condition was taken out of service. A Toyota forklift [e.g.184/9444] with reported defects, to include but not limited to defective brakes, was not removed from service.
