29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) Throughout facility - On or about 10/24/2016, employees were exposed to continuous noise at 85.6% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or equivalent sound levels of 89 dBA during 380 minutes sampling period on November 2, 2016. The exposure calculation included a zero increment of the 100 minutes not sampled. An audiometric testing program was not provided to employees operating machines such as, but not limited to FM-46, NYS-009, Cuttoff#1 and Automated Cell.  b) Throughout facility - On or about 10/24/2016, employees were exposed to continuous noise at 75.8% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or equivalent sound levels of 88 dBA during 380 minutes sampling period on November 2, 2016. The exposure calculation included a zero increment of the 100 minutes not sampled. An audiometric testing program was not provided to employees operating machines such as, but not limited to FM-46, NYS-009, Cuttoff#1 and Automated Cell.

The employer did not institute a training program and ensure employee participation in the program:  a) Throughout facility - On or about 10/24/2016, employees were exposed to continuous noise at 85.6% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or equivalent sound levels of 89 dBA during 380 minutes sampling period on November 2, 2016. The exposure calculation included a zero increment of the 100 minutes not sampled. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Throughout facility - On or about 10/24/2016, employees were exposed to skin, eye and respiratory tract irritations, in that training and information for chemicals were not provided to employees while cutting, grinding, painting and operating forklift trucks and were exposed to chemicals such as, but not limited to steel, stainless steel, and propane.
