29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the EMPLOYER HAD NOT MET ALL THE ELEMENTS OF SLOPING/BENCHING OPTION (2), -3 OR (4)) Kruczek Construction Inc. project site located on South Business Dr, Sheboygan, WI: On October 25, 2016, employees were exposed to engulfment while attempting to locate a buried fiber optic cable in an excavation 5.9' deep, 7' wide, and 7' long, in class C soil that was not properly sloped on the sides to prevent cave in. Kruczek Construction Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 980686, citation number 2, item number 2A, and was affirmed as a final order on 1/20/15, with respect to a workplace located at the intersection of Badger Ave and Packer St. Appleton, WI 54913. Kruczek Construction Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 952937, citation number 1, item number 2, and was affirmed as a final order on 4/23/14, with respect to a workplace located on North Overland Rd. Hobart, WI 54115.
