29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) United Construction LLC at 9310 Yucca Way, Thornton, CO 80229: On and before October 26, 2016, the exposing employer did not ensure that employees were provided protective helmets, while working in areas where there was a possible danger of head injury from falling objects.  An employee worked in a trench that was 10 feet deep but the spoil pile was not at least two feet from the edge of the excavation. This condition exposed the employees to the hazard of spoil pile material falling and striking the employees head.      Abatement Note: The employer must provide each employee with head protection that meets the specifications contained in any of the following consensus standards:  -American National Standards Institute (ANSI) Z89.1-2009, "American National Standard for Industrial Head Protection," incorporated by reference in �1926.6;    -American National Standards Institute (ANSI) Z89.1-2003, "American National Standard for Industrial Head Protection," incorporated by reference in �1926.6; or    -American National Standards Institute (ANSI) Z89.1-1997, "American National Standard for Personnel Protection-Protective Headwear for Industrial Workers-Requirements," incorporated by reference in �1926.6.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  (a) United Construction LLC at 9310 Yucca Way, Thornton, CO 80229: On and before October 26, 2016, the exposing employer did not ensure that the spoil pile was at least two feet from the edge of the trench. The trench measured approximately 50 feet in length with an 80 degree bend in the middle, 18 feet in width on the east end, 12 feet in width on the west end, and 10 feet in depth. This condition exposed the employee to the hazard of spoil pile material falling into the trench or causing the trench wall to collapse.

29 CFR 1926.651(b)(2): Utility companies or owners were not contacted within established or customary local response times, advised of the proposed work, and asked to establish the location of the utility underground installations prior to the start of an actual excavation:     (a) United Construction LLC at 9310 Yucca Way, Thornton, CO 80229: On and before October 26, 2016, the exposing employer did not ensure that each employee conducting work in the trench were protected from striking utility lines by having the lines located prior to work. The trench measured approximately 50 feet in length with an 80 degree bend in the middle, 18 feet in width on the east end, 12 feet in width on the west end, and 10 feet in depth. The condition resulted in an employee striking a gas line and exposed an employee to gas hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmosphere and other hazardous conditions:    (a) United Construction LLC at 9310 Yucca Way, Thornton, CO 80229: On and before October 26, 2016, the exposing employer did not ensure that daily inspections of a trench, that was approximately 50 feet in length with an 80 degree bend in the middle, 18 feet in width on the east end, 12 feet in width on the west end, and 10 feet in depth were made by a competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify that the trench had a single bench on each side with an approximate height of 5 feet and width of 2 feet and contained type B soil. This condition exposed employees to a crushing hazard by trench wall cave-in.     Abatement Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

This condition exposed employees to a crushing hazard by trench wall cave-in.
