29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the residential construction site located at 16408 Knox Street in Overland Park, Kansas:  Employees engaged in painting activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to Sherwin/Williams 950A Siliconized Acrylic Latex Caulk.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59)  At the residential construction site located at 16408 Knox Street in Overland Park, Kansas:  Employees engaged in painting activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  A copy of the required safety data sheet for Sherwin/Williams 950A Siliconized Acrylic Latex Caulk was not maintained at the residential construction site exposing employees to dermatitis and eye injury.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the residential construction site located at 16408 Knox Street in Overland Park, Kansas:  Employees engaged in painting activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. Employees had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as Sherwin/Williams 950A Siliconized Acrylic Latex were used at the residential construction site.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  At the residential construction site located at 16408 Knox Street in Overland Park, Kansas:  Employees engaged in residential painting activities were exposed to fall hazards of approximately 10 feet  from the eave of the residence to the ground below while accessing and exiting the roof in that the portable ladder did not extend at least 3 feet above the upper landing and was not secured to the residence/structure.
