29 CFR 1926.1204(n): Under the permit space program required by 29 CFR 1926.1203(d) the employer did not review the permit space program, using the canceled permits retained under �1926.1205(f), within 1 year after each entry and revise the program as necessary to ensure that employees participating in entry operations are protected from permit space hazards.    Note to paragraph (n). Employers may perform a single annual review covering all entries performed during a 12-month period. If no entry is performed during a 12-month period, no review is necessary.  The employer did not annually review the permit space program.  Employees are exposed to a potential hazardous atmosphere during manhole installation which requires an entrant to enter the manhole to set up a laser leveler for alignment purposes.

29 CFR 1926.651(b)(4): While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees:  Location:  Rosemary, Philo, and Kathleen Sewer Separation project, at or near the intersection of Forman Road and Candace Drive in Affton, MO  63123.  On or about October 27, 2016, the employer did not ensure that the natural gas line and water line crossing the excavation were protected or supported to prevent damage from the excavator bucket, trench protective systems, steel sheets, hoisted sections of the 48-inch diameter concrete pipe, and/or falling soil.  Unnerstall Contracting Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CRF 1926.651(b)(4), which was contained in OSHA inspection number 315916288, citation number 1, item number 5 and was affirmed as a final order on 04/20/2012, with respect to a workplace located at or near 1938 Western Cape Drive, St. Louis, MO  63146.
