OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards associated with improper automobile lift operations:    (a) On or about October 12, 2016, and at times prior, Wal-Mart Stores, Inc. employees were exposed to crushing and struck-by hazards while working on automotive lifts as follows:    1 - Lifts were not inspected annually by a qualified person.  2 - Lifts were not inspected daily during use to ensure that they were properly maintained and functional.  3 - Lift #1 Was missing 3 out of 4 rubber pads on the swing-arm bases. 29 CFR 1910.106(e)(9)(iii): Combustible waste material and residues in a building or unit operating area were not kept to a minimum, stored in covered metal receptacles and disposed of daily:    (a) On or about October 12, 2016, and at times prior, Wal-Mart Stores, Inc. did not ensure that combustible waste material and residues in a building were kept to a minimum, stored in covered metal receptacles and disposed of daily. Employees were exposed to fire hazards in that oily rags were stored in open plastic containers, and disposed of weekly. 29 CFR 1910.305(g)(2)(iii): Flexible cords and cables were not connected to devices and fittings so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminal screws:    (a) On or about October 12, 2016,and at times prior, Wal-Mart Stores, Inc.., did not ensure that flexible cords and cables were connected to devices and fittings, so that strain relief was provided that would prevent pull from being directly transmitted to joints or terminals. In the service shop area, a live 120-V cord providing power to a computer station showed signs of strain, inner wiring was visible, exposing employees to contact with electrical hazards.
